Hosting terms of service

Short and clear: what you get, how payment works and what happens if you want to leave.

1. Service provider

The service is provided by Quartz obrt, owner Marin Čehajić, Rijeka, Croatia, OIB (Croatian tax number) 01638027506 (hereinafter: Quartz). Quartz is not registered for VAT.

2. What is included

Quartz hosting includes the items listed on the Hosting page at the time of ordering: server space, the domains on the plan, SSL, a daily backup with restore up to 7 days back, attack protection, free migration of an existing website and setup of one email address with an external provider. Domain registration is billed separately. Email mailboxes are not part of the service.

3. Payment and term

Hosting is paid yearly in advance and runs for one year from activation. Before it expires, we send the invoice for the next year. Maintenance is paid monthly, and website builds according to the quote (usually 50% upfront and 50% on delivery). Invoices do not include VAT, as Quartz is not registered for VAT.

4. Non-payment

If the renewal invoice is not paid within 15 days of the due date, Quartz may temporarily suspend the website. The data is kept for another 30 days, after which it may be permanently deleted.

5. Domains

The client is always the domain holder. Domains are registered through accredited registrars at the prices on the Hosting page and renewed once a year for as long as the service lasts.

6. Backup

The daily backup is for restoring the website after a failure or mistake. We recommend that you also keep copies of important data yourself; Quartz is not liable for data that was not covered by the backup.

7. Acceptable content

Illegal content, spam, malicious code and content that endangers the server or other users are not allowed. In such cases Quartz may suspend the website immediately.

8. Support and emergencies

Support is available on working days, and 24/7 for emergencies. An emergency is a website that is down or under attack. Content changes are not emergencies and are handled during regular hours.

9. Cancellation

You can cancel the service at any time; it remains active until the end of the paid period. On request we hand over all files and the website database, free of charge.

10. Liability

Quartz does its best to keep the service running without interruption, but is not liable for damage caused by interruptions it could not prevent (an infrastructure provider failure, force majeure). Total liability is limited to the amount paid for the service in the last 12 months.

11. Changes and governing law

We notify clients of changes to these terms by email at least 30 days in advance. The relationship is governed by Croatian law, and the court in Rijeka has jurisdiction over disputes.
